Family Cybersecurity Jurisprudence and Digital Sovereignty Challenges: A Foundational Approach in Light of Islamic Legal Maxims and Modern Legislation.

Family Cybersecurity Jurisprudence and Digital Sovereignty Challenges: A Foundational Approach in Light of Islamic Legal Maxims and Modern Legislation.

This study transcends traditional approaches to cybercrime by inaugurating a novel cognitive field termed "Family Cybersecurity Jurisprudence." The paper posits that "Digital Sovereignty" is no longer exclusive to states but is an inherent right of the family unit, whose boundaries have become permeable to "Surveillance Capitalism" and cross-border data flows. The study aims to deconstruct the legislative and ethical vacuum left by rapid technological advancement, which has transformed homes into "glass houses," exposed to algorithmic manipulation and cyber violations. Adopting a composite methodology, the research bridges "Technical Analysis" of emerging risks with "Legal and Sharia Foundation" of these calamities. The study concludes by proposing a foundational model for a "Secure Digital Family," suggesting legislative and educational mechanisms that redefine "Privacy" and "Sanctity" in the cyber age.
